One of the most critical factors in achieving this is ensuring business operations comply with the Consumer Protection Act, for which the Office of the Consumer Protection Board (OCPB) is the primary regulatory body. Product Labeling Control: The Core of Transparency

The OCPB places the highest importance on product labeling. Gems and jewelry are classified as "Controlled Label Goods" under the Notification of the Committee on Labels, B.E. 2544 (2001). Correct and complete labeling is not just a legal requirement; it is a vital tool for building consumer confidence.

The 5 Mandatory Details for Product Labels

The labels on your jewelry and gemstone products must include the following five details:

  1. Vendor Information: Clearly state the name and business location or registered trademark of the manufacturer, distributor, or importer. (In the case of imported goods, the country of origin must also be specified).

  2. Gemstone Details: You must specify the trade name and clearly classify the gemstone type as Natural Gemstone, Synthetic Gemstone, or Imitation Gemstone.

  3. Gemstone Weight: The weight of each gemstone must be displayed in Carats (ct).

  4. Purity of Precious Metals: Indicate the purity of the setting, for example, 18K Gold or 75%.

  5. Price: The price must be clearly stated in Thai Baht as the primary currency. Other currencies may be listed as supplementary.

Caution: Prohibitions on the Use of Potentially Confusing Terminology

To prevent consumer misunderstanding, the OCPB has established strict prohibitions on terminology:

  • Do not combine the name of a natural gemstone with synthetic or imitation stones:

    • Incorrect Examples: "Synthetic Emerald", "Imitation Ruby"

    • Required Terminology: You must clearly state "Synthetic Gemstone" or "Imitation Gemstone".

  • Do not use the word "Diamond" for any other gemstone that is not naturally composed entirely of the element Carbon.

Other Regulatory Measures and Legal Penalties

In addition to labeling, the OCPB's consumer protection measures extend to regulating sales contracts, the details on receipts, and requiring that all product warranties be provided in writing to be legally binding.

Penalties for Non-Compliance

Failure to comply with product labeling regulations carries clear legal penalties. The OCPB regularly conducts inspections in cooperation with partner agencies.

  • For sellers/distributors: Penalties include imprisonment for up to 6 months, a fine of up to 100,000 Baht, or both.

  • For manufacturers or importers: Penalties include imprisonment for up to 1 year, a fine of up to 200,000 Baht, or both.
