OCPB Requirements Every Jewelry Entrepreneur Must Know

As the Thai Gem and Jewelry Traders Association (TGJTA), we are committed to elevating the standards and credibility of our industry. One of the most critical factors is ensuring business operations align with Consumer Protection Laws, overseen by the Office of the Consumer Protection Board (OCPB).

This guide summarizes the essential requirements that all entrepreneurs must implement to ensure transparency and build consumer confidence.


Labeling Control: The Core of Transparency

The OCPB places the highest priority on "Product Labels." Gems and jewelry are classified as "Label-Controlled Products" under the Notification of the Committee on Labels No. 7 (B.E. 2544). Correct and complete labeling is not just a legal mandate; it is a vital tool for building trust with your customers.

The 5 Mandatory Requirements for Product Labels

Your jewelry and gemstone labels must include the following details in full:

  1. Vendor Information: Clearly state the name and place of business (or registered trademark) of the manufacturer, distributor, or importer. (For imported goods, the country of origin must be specified).

  2. Gemstone Details: Specify the Trade Name and clearly classify the Type of Gemstone (e.g., Natural Gemstone, Synthetic Gemstone, or Imitation/Artificial Gemstone).

  3. Gemstone Weight: Display the weight of each type of gemstone in Carats (ct).

  4. Precious Metal Purity: State the purity of the setting/mounting, such as 18K Gold or 75% Gold.

  5. Price: The price must be stated primarily in Thai Baht (THB). Other currencies may be listed alongside it.


Important Precautions: Prohibited Terminology

To prevent consumer confusion or misleading claims, the OCPB strictly prohibits certain phrasing:

  • Prohibition on linking Natural Names with Synthetic/Imitation terms:

    • Incorrect: “Synthetic Emerald,” “Artificial Ruby.”

    • Required: You must clearly label them as “Synthetic Gemstone” or “Imitation Gemstone.”

  • The term "Diamond": You may not use the word "Diamond" (เพชร) for any other gemstones that are not entirely composed of natural Carbon.


Other Regulatory Measures & Legal Penalties

Beyond labeling, the OCPB oversees other measures to ensure comprehensive protection, including the control of Sales Contracts, requirements for Official Receipts, and the mandate that all Product Warranties must be provided in writing.

Penalties for Non-Compliance

Failure to comply with labeling regulations carries specific legal penalties. The OCPB regularly collaborates with partner agencies to conduct inspections:

  • For Retailers/Distributors: Imprisonment for up to 6 months, or a fine of up to 100,000 THB, or both.

  • For Manufacturers or Importers: Imprisonment for up to 1 year, or a fine of up to 200,000 THB, or both.
